Definitions

The following defined terms are used throughout these Terms of Service. Where the context requires, the singular includes the plural and vice versa. These Terms were last updated on 18 September 2026.

Term Definition

“Company” / “We” / “Us” Cancel Culture LLC, a limited liability company registered in the State of Wyoming, EIN 001792795, with registered address at 30 N Gould St Ste N, Sheridan, Wyoming 82801, United States, operating the Curlashes brand and website.

“Website” The online store operated at curlashes.com and all associated subdomains, pages, features and services accessible through that domain.

“User” / “Customer” / “You” Any individual or entity accessing the Website or placing an Order, whether registered or browsing as a guest. Where you are a consumer purchasing for personal use, applicable consumer protection law governs your relationship with us.

“Order” A purchase transaction submitted by you through the Website, constituting an offer to enter into a contract of sale with us for one or more Products at the prices and on the terms displayed at checkout.

“Products” The cosmetic and personal care items listed for sale on the Website — makeup, skincare, lash products, tools and accessories — including all descriptions, images and specifications presented on their respective product pages.

“Policy” Collectively, these Terms of Service together with our Privacy Policy, Shipping Policy and Returns & Refunds Policy, all of which form part of the agreement between you and us. In the event of conflict, these Terms of Service govern unless otherwise specified.

“Business Day” Any calendar day that is not a Saturday, Sunday, or a federally recognised public holiday in the United States, as applicable to the relevant activity (order processing, shipping, or customer service response times).

Use of Website

By placing an Order on curlashes.com you confirm that you are at least 18 years of age and legally able to enter into a contract. Minors may use the Website and our Products only under the supervision of a parent or legal guardian, and any Order must be placed by that adult using their own payment method.

The Website is made available for personal, non-commercial use. You agree not to use the Website in any manner that could damage, disable, overburden or impair it, or interfere with any other party’s use of it. We reserve the right to terminate or restrict your access at any time, without notice, if you breach any provision of these Terms.

Permitted uses

Account creation

If you create a customer account on curlashes.com, you are responsible for keeping your login credentials confidential and for all activity that occurs under your account. Notify us immediately at support@curlashes.com if you become aware of unauthorised access. We reserve the right to suspend or close accounts that breach these Terms or are associated with suspected fraudulent activity.

Reviews and user content

If you submit a product review, photograph or other content to the Website, you confirm it is your own honest opinion and experience, and you grant us a non-exclusive, royalty-free licence to display, reproduce and use that content in connection with the Curlashes brand, including in marketing. We may remove content that is abusive, misleading, or that we reasonably believe to be fake. In line with FTC guidance, we do not offer payment, free product or discounts in exchange for a positive review, and any review we do incentivise will be clearly labelled as such.

Products & Pricing

We take care to ensure all product descriptions, images and specifications on curlashes.com are as accurate as possible. However, we do not warrant that descriptions, shades, photographs or other content on the Website are entirely error-free or complete.

Shades and finishes may appear differently on your screen depending on your device’s display calibration, monitor settings and ambient lighting. We are not responsible for colour discrepancies that arise from differences between your screen and the physical product. If exact shade matching is critical to your purchase, contact us before ordering and we will describe the product in more detail.

Pricing & currency

› Prices are displayed in USD and shown at checkout before you complete your Order

› Shipping charges are calculated and displayed at checkout before you confirm payment

› We may correct typographical or system pricing errors at any time before dispatch, and will notify you and offer a correction or cancellation

› Prices may change without notice but will not change after your Order has been accepted and confirmed

› Promotional and sale prices are valid for the stated promotion period only

Availability & quantities

› All Products are subject to availability; we do not guarantee that any Product remains in stock at all times

› We may limit the quantity of any Product purchased per customer, per household or per Order at our discretion

› If a Product becomes unavailable after your Order is placed, we will notify you and issue a full refund promptly

› Stock levels shown on the Website are updated regularly but may not reflect simultaneous purchases

Cosmetic products — important

Everything we sell is a cosmetic product, not a medicine.

Our Products are cosmetics as defined under the Federal Food, Drug, and Cosmetic Act. They are intended to cleanse, beautify or alter the appearance of your skin, lips, brows and lashes. We do not claim that any Product diagnoses, treats, cures or prevents any disease or medical condition, and nothing on the Website should be read as medical advice.

Results vary

Where a Product description refers to fuller, longer or conditioned lashes and brows, or to improved appearance of the skin, these describe cosmetic effects. Individual results vary with skin type, hair type and consistency of use, and no specific outcome is promised or guaranteed.

Ingredients & sensitivity

Full ingredient lists are printed on product packaging. You are responsible for checking ingredients against any known allergy or sensitivity before use. We strongly recommend patch-testing any new product, keeping products away from the eye itself, and discontinuing use if irritation occurs.

Use as directed: follow the instructions supplied with each Product, including any instructions for heated devices such as eyelash curlers. If you have a known skin or eye condition, wear contact lenses, are pregnant or breastfeeding, or are using prescription eye medication, consult a qualified medical professional before using lash or brow serums. If you experience a severe or persistent reaction, or any change in vision, seek medical advice immediately.

Pricing errors

If a Product is listed at an obviously incorrect price due to a typographical error, technical fault or system error, Cancel Culture LLC is not obliged to fulfil your Order at that price. We will notify you as soon as practicable and offer you the choice of buying at the correct price or cancelling for a full refund. We will not process or ship an Order where a clear pricing error has been identified without your explicit confirmation of the corrected price.

Orders & Payment

Placing an Order on curlashes.com constitutes an offer to purchase the selected Products on the terms and at the prices displayed at checkout. A binding contract is formed when we send you an order confirmation email accepting your Order.

Our order confirmation email constitutes our acceptance of your offer. Please keep it as a record of your purchase. If you do not receive a confirmation email within 24 hours of placing your Order, check your spam or junk folder and then contact us at support@curlashes.com with your details.

When we may cancel your order

✗ Payment failure, declined card, or unsuccessful authorisation at checkout

✗ The Product is out of stock or discontinued after your Order is submitted

✗ A significant pricing error or system fault is identified on the ordered Product

✗ Suspected fraudulent transaction or misuse of our platform

✗ Delivery is not available to the address provided at checkout

Payment is charged in full at checkout when you complete your Order. All payment processing is handled securely through our payment processor and is subject to their terms and privacy practices. We do not store your full card details on our systems. If we cancel an Order after payment has been taken, a full refund is issued to your original payment method, typically within 10 business days depending on your bank or card issuer.

CAN-SPAM & email communications

By placing an Order you will receive transactional emails relating to your purchase: order confirmation, dispatch and tracking, and delivery notifications. These are not marketing communications and are necessary to fulfil your Order. If you have opted in to marketing emails, you may unsubscribe at any time using the link in any marketing message. We comply with the US CAN-SPAM Act, and we do not sell your email address to third parties. See our Privacy Policy for full detail on how we handle your personal information.

Shipping & Delivery

Shipping charges are calculated and shown at checkout before you confirm payment. Full shipping terms are set out in our Shipping Policy, which forms part of your agreement with us. The key terms are summarised below.

Processing and delivery timeframe

Orders are processed and dispatched within 24–48 hours, excluding weekends and public holidays. Estimated delivery is 7–12 business days from dispatch within the United States. Delivery timeframes are estimates only and are subject to carrier capacity and events beyond our control. A tracking number is emailed to you once your Order is dispatched.

Passing of risk

Risk in the goods passes to you on delivery to the address specified in your Order. Title passes to you on receipt of full payment. We are not responsible for goods lost or damaged after delivery has been completed and confirmed by the carrier at your specified address.

Carrier delays

Cancel Culture LLC is not liable for delays caused by the shipping carrier, natural disasters, severe weather, strikes or any other circumstances beyond our reasonable control. Where a significant and unexpected delay occurs, contact us and we will help track your shipment and escalate with the carrier.

Incorrect delivery address

You are responsible for providing an accurate and complete delivery address at checkout. We are not liable for non-delivery or delay arising from an incorrect, incomplete or inaccessible address provided by you. Address corrections must be requested before dispatch, which is usually within 24–48 hours of ordering. Once an Order has been handed to the carrier we cannot guarantee an address change, and any cost of address correction or re-delivery may be passed to you.

Returns & Intellectual Property

Your rights to return Products, and the intellectual property protections applicable to all Website content, are set out in this section. Our full Returns & Refunds Policy is available separately and is incorporated into these Terms by reference.

30-day return window

You have 30 days from the date of delivery to request a return. Because our Products are cosmetics, items must be unused, unopened and with any hygiene seal intact, in their original packaging. Opened, swatched or used products cannot be returned for hygiene reasons. Approved refunds are issued to the original payment method within 10 business days of inspection.

How to initiate a return

Contact us at support@curlashes.com with your order number and reason within 30 days of delivery. We will issue a Return Authorisation and the return address. Return postage for change-of-mind returns is arranged and paid for by you; we do not issue prepaid return labels. Items that arrive damaged, defective or incorrect are handled at our cost.

Nothing in our Returns & Refunds Policy or these Terms limits or excludes any mandatory statutory right you have under applicable US federal or state law.

All content, logos and trademarks on curlashes.com are owned by or licensed to Cancel Culture LLC.

The entirety of the curlashes.com Website — including all text, product descriptions, images, photographs, logos, brand marks, graphic elements, page layouts and underlying code — is the exclusive intellectual property of Cancel Culture LLC or its licensors. All rights are reserved worldwide.

What you may do

Browse and use the Website for personal, non-commercial purposes. Share product page links. Reference Curlashes in editorial contexts with appropriate attribution. Contact us for permission for any other use.

What you may not do

Reproduce, copy or redistribute Website content without written permission. Use the Curlashes name, logo or brand marks in any commercial context. Scrape or republish product descriptions or images. Reverse-engineer any part of the Website.

DMCA notice: if you believe content on curlashes.com infringes your copyright or other intellectual property rights, send a written notice of claimed infringement to support@curlashes.com including: identification of the work claimed to be infringed; identification of the material claimed to be infringing and where it sits on the Website; your contact information; a statement of good faith belief; and your electronic signature. We respond to valid DMCA notices promptly.

Limitation of Liability & Disclaimers

The Website and its contents are provided “as is” and “as available” without warranties of any kind, express or implied, to the fullest extent permitted by applicable law. Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for any liability that cannot lawfully be excluded.

Cancel Culture LLC does not warrant that the Website will be uninterrupted, error-free, or free of viruses or harmful components. You use the Website at your own risk.

We are not liable for

✗ Any indirect, incidental, special, punitive or consequential damages arising from your use of the Website or Products

✗ Loss of profits, revenue, business opportunity, data or goodwill, even if we were advised of the possibility

✗ Delays caused by the carrier or by circumstances beyond our reasonable control

✗ Non-delivery or loss arising from an incorrect delivery address provided by you

✗ Any reaction arising from use of a Product contrary to its instructions, or where a known allergy or sensitivity to a listed ingredient existed

✗ The content, products or practices of any third-party website linked from curlashes.com

These exclusions do not affect

✓ Your mandatory statutory rights under US federal and state consumer protection law

✓ Any liability for death or personal injury caused by our negligence or wilful misconduct

✓ Any liability for fraud or fraudulent misrepresentation

✓ Your right to a remedy where a Product supplied was defective, contaminated or not as described

Maximum liability cap

Our total aggregate liability to you is capped at the value of the Order giving rise to the claim.

To the fullest extent permitted by applicable law, and subject to the carve-outs above, our total aggregate liability to you in connection with any single Order or claim shall not exceed the total purchase price you paid for the Product or Products to which the claim relates. This cap does not apply to claims that cannot be limited under mandatory law.

Product warranties

We make no express product warranties beyond what applicable law requires. Implied warranties are disclaimed to the fullest extent permitted by law. This does not affect mandatory statutory guarantees under applicable US federal or state law, nor your rights where a Product was defective or not as described.

FTC disclosure

We comply with US Federal Trade Commission guidelines on material disclosures. Where we use affiliate links, sponsored content or paid endorsements on the Website or our social channels, these are clearly disclosed as required by FTC rules.

Nothing here is medical advice

Product descriptions, guidance published on the Website, and any advice given by our support team about shades, formulas or routines are provided for general cosmetic purposes only and are not medical or dermatological advice. They are not a substitute for consultation with a qualified healthcare professional. If you have a skin condition, an eye condition, or a known allergy, speak to your doctor, dermatologist or optometrist before using a new cosmetic product.

Governing Law & Dispute Resolution

These Terms of Service are governed by and construed in accordance with the laws of the State of Wyoming, United States of America, without regard to its conflict of laws principles. This choice of law does not override any mandatory consumer protection rights you hold under applicable US federal or state law.

Jurisdiction & governing law

Wyoming law governs these Terms.

Any dispute, claim or controversy arising out of or relating to these Terms, your use of the Website, or any Order shall be subject to the exclusive jurisdiction of the state and federal courts located in Sheridan County, Wyoming, United States of America, except where mandatory consumer protection law provides otherwise.

Contact us first

Before escalating any dispute to a court, a payment provider or a third-party body, please contact us at support@curlashes.com. We resolve the vast majority of issues within a few business days when given the chance to do so directly, and we will engage with your concern in good faith.

Class action waiver

To the fullest extent permitted by applicable law, you agree that any dispute resolution proceedings will be conducted on an individual basis only, and not in a class, consolidated or representative action. This waiver does not apply where prohibited by mandatory law in your state.

Changes to these Terms

We may update these Terms from time to time to reflect changes in applicable law, our operations, or our product range. Where we make material changes we will give at least 30 days’ notice by posting a clear notice on curlashes.com or by emailing registered customers. The version in force when you place an Order governs that contract. Continued use of the Website after an update takes effect constitutes acceptance of the revised Terms for future transactions. If you do not agree to the revised Terms, please discontinue use of the Website.

United States market only

Curlashes ships within the United States and does not operate in the European Union or participate in any EU Online Dispute Resolution platform. Customers who wish to escalate a dispute beyond our customer service team may refer the matter to the Federal Trade Commission at ftc.gov or to their state attorney general’s consumer protection office.

Account
